with the fiscal cliff. the senate majority leader says it is up to the house to pass the senate plan. >> so i say to mr. speaker, take the escape we have left you. put the economic fate of the nation ahead of your own fate as speaker of the house. millions of middle class families are nervously watching, waiting and counting down the moments until our taxes go up. >> senate minority leader mitch mcconnell is expected to take the senate floor a few minutes from now. he has been saying his office has been saying throughout the day when senate democrats offer a plan, republicans will review it. so republicans are very much waiting for democrats to offer a new type of fiscal cliff proposal. democrats are saying to republicans in the house, they should just pass that bill that passed the senate earlier this year, one that extends tax rates for families earning less than $250,000 a year. so very much bit of a stalemate going on here in washington as we move ever closer to the deadline. back to you. ashley: my first reaction is, so what's new? >> not much. ashley: at least it is something.

and all house members are not here in washington trying to work out a deal on the fiscal cliff. here is more from leader reid a short time ago. >> if we go over the cliff and it looks like that's where we're headed, mr. president, the house of representatives, as we speak, with four days left after today before the first of the year aren't here with the speaker having told them they will give them 8 hours notice. i can't imagine their consciences. >> reporter: of course president obama has left hawaii. he is heading back to washington from his family vacation. we learned from the white house that the president had made calls to the top four congressional leaders mcconnell and boehner on the republican side, pelosi and reid on the democratic side. we'll see what the president has in mind when he touches down back in washington a little later this morning, harris. harris: mike you mentioned it. i'm mentioning it too. it is coming into the newsroom from senator mcconnell's spokesperson and just wondering what the republicans say they want. they want to review legislation and make decisions how best to proceed.

congressional leaders cut their vacations short, to deal with fiscal cliff negotiations. they have five days to make a deal. and housing continues to be the bright spot in the u.s. economy: home prices post their biggest advance in two years. that and more tonight on "n.b.r."! christmas may be over, but the holiday shopping season continues. many consumers hit the malls today to return gifts and buy what they really wanted. and this is the time many gift cards get redeemed. but for retailers, holiday sales so far have been a flop. sales in the two months leading up to christmas, rose just 0.7%, according to mastercard advisors that tracks the numbers. that's way below what the retail industry was predicting. erika miller spoke with retail expert dana telsey and began by asking what happened. >> i think there were a confluence of events, extra long season. hurricane sandy. tragedy in ct. >> none of the events out there were feel good factor events. it was all for consumer morale. >> when you look at the weakness this holiday season, how much of the blame do you put on retailers for not having in

fiscal cliff is really in view now. the home county of house speaker john boehner butler county, ohio, currently under a blizzard warning. house republican leaders holding a conference call earlier today on the fiscal cliff, but so far they have not yet called on lawmakers to return to capitol hill. but they have said they will give a 48 hour warning if they plan to do that the white house saying the president is cutting his holiday vacation in hawaii short to return to d.c. to work on a deal to try to stop those automatic tax hikes and deep spending cuts from kicking in on january 1st. and if they don't reach a deal before then, many economists say we will dip back into a recession. i had henly house republican leaders didn't have a lot of new information for their lawmakers. they would have 48 hour notice if they are needed to pray back to washington from various districts around the country. that tells us they are being noncommittal at this point because they frankly do not know whether or not there will be a deal to avert the fiscal cliff. now, after that conference call. the house speaker john boehner, his number two eric cantor the majority leader

to put on some kind of an agreement and as we go over the fiscal cliff, both sides seem to be working hard to do that. the president spoke with congressional leaders from hawaii last night and tried to get a sense of where we are and now it's sort of sits in the hands of the senate and the house comes back into session on sunday before they could get it through in the final 24 hours before we all go over that cliff. >> so what's the role of the president into all of this? i mean, what do you expect from him in the coming days and what is he doing to get this resolved? >> reporter: well, the rule he could play sl he could bring the leaders together, either here at the white house and try to get them to some agreement or just gentleman cajole them privately on the phone and urging them to some middle ground but the other thing is the bully pull pit. he used that very effectively in the payroll tax fight, lobbying the american people to urge congress to take ak. with such little time, we're not sure if it can have much of an effect and given what senator mcconnell said today, we're not sure how much room there is really to negotiate. here's a little bit o

we're five days from going over the fiscal cliff. president obama left hawaii early to be back in washington today. the senate is also come back from christmas vacation to work on a deal. sources tell us that majority leader harry reid will push a scaled back version of the fiscal cliff package that president obama laid out late last week and no word yet on when the house might come back. democrats say the only hope we have of something getting through the house, the senate, and the white house may be a last-minute deal. cnn radio's lisa desjardins is on capitol hill. the big question is how a deal gets done. >> it is possible for a deal to be done before january 1st. it is not easy though for a couple of reasons. one the house has a 72-hour rule, legislation needs to be presented to the public for 72 hours before they vote but you know how that works, ali, they can get around that. they have in the past voted around that rule. the senate has filibuster problems potentially, sometimes it can take up to a week to get through the several different votes that are needed to overcome a filibuster, but if there's no filibuster and if the house decides not to deploy that 72-hour rule, they still could get a deal done

debt ceiling. that is not directly implicated in the fiscal cliff talks, but it's part of the larger issue of debt and deficit that congress has to deal with. secondly, house run leaders conferred and sent a letter to democrats to say it is up to the senate to act. the house has already acted on a bill to avert the fiscal cliff. democrats have no intention of taking up that house bill, which would extend all of the tax cuts into 2013. the approximated says he's not going to do that. plus a senate democrat leader told me there is a possibility of extending tax cuts for those under $250 thoid, but turning off the automatic across the board budget cuts. that will be a temporary measure. and finally, president obama has returned from his vacation in hawaii to try to kick start those talks. but the white house officials tell me there are no signs of progress yet. they have to hope that when members come back to washington on the 27th, that is thursday wblg that both the president, democrats in the senate, republicans in the senate and then both parties in the house can come together on at least a short-term deal. back to you. >> a short-term deal. joining us now is tim stanley, a u.
